The problem of the formation of the national systems of activities of technical regulation in Russian Federation

Abstract

Subject / Topic The system of technical regulation legal acts in the Russian Federation in the context of transition to supranational legislation within the framework of the EAEC is considered within the article presented.

Goals / objectives The main goal of the conducted research was to consider the specifics of the formation of a supranational system of acts of technical regulation in the Russian Federation, to identify contradictions in law enforcement practice and to formulate proposals for legislation improvement in this area.

Methodology Such research methods as analysis, synthesis, specification, legal modeling, extrapolation, formal-logical and other methods of scientific research have been employed within the study conducted.

Conclusion and Relevance The results of the analysis of a number of documents of the system of technical regulations of the Russian Federation lead to the conclusion on absence of systematicity in adopting acts of technical regulation and usage of an inadequately elaborated conceptual framework that allows broad interpretations. The peculiarities of supranational legislation within the framework of the EAEC in this area require the construction of a hierarchical structure of regulatory documents that are continuously updated taking into account the latest achievements of science, technology, economic development and analysis of their application, with all necessary and sufficient interrelations among themselves, covering all industrial sectors.

Issues of the abuse of rules suspension and constraints in the censorship review

Subject / topic The article deals with the subject matter jurisdiction and court jurisdiction of civil cases in arbitration courts and courts of general jurisdiction.
Goals / objectives: The main goal of the study conducted was to analyze the possibility of illegal abuse of subject matter jurisdiction and territorial jurisdiction change in the civil and arbitral proceedings. Authors investigate the problematic issues of subject matter jurisdiction and territorial jurisdiction of civil casesa and consider the possibility of using its’change for the purpose of committing economic crimes.
Methodology Such research methods as analysis, synthesis, comparison, abstraction, problem statement, hypothesis construction, specification, monitoring have been employed within the study conducted.
Conclusion and Relevance Procedural legislation in the field of civil cases in arbitration courts and courts of general jurisdiction does not establish clear rules for determining subject matter jurisdiction and territorial jurisdiction. In many respects this is due to the fact that the arbitration and civil proceedings are regulated by various regulatory and legal acts. In addition to this judicial practice in this area is still not formed completely. These circumstances may be the determinants of economic crimes committed through illegal judicial decisions.
As a proposal to change the situation it is suggested to eliminate the institution of subject matter jurisdiction in the civil and arbitration process as well as to formulate more precise rules for determining the jurisdiction excluding the possibility of its’ abuse.

Divorce and some problems of state registration

Abstract

Subject/theme The subject of the study is the social relations formed during the dissolution of marriage between spouses including those in connection with the state registration of divorce as an act of civil status.

Goals / objectives The aim of the study is a comprehensive analysis of the particular provisions of legislation on divorce in the Russian Federation, the formation of a holistic scientific understanding of divorce as the basis for termination of the legal relationship of the spouses and as a remedy for marital and family rights, the development of individual recommendations to improve the legislation related to the legal regulation of the state registration of divorce.

Methodology The methodological basis of the research includes general methods of cognition, general scientific methods, which include a systematic and logical method, as well as analysis, synthesis and analogy, special scientific methods, such as the method of comparative law and formal legal method.

Conclusion Dissolution of marriage as the basis of termination of legal relations of spouses acts as a complicated legal structure including set of facts – actions. It is necessary to differentiate such legal actions, included in the relationship of the spouses upon dissolution of marriage, as filing the application for divorce and the dissolution of the marriage. Thus, there are two groups of relations by their legal nature: organizational and procedural. Dissolution of marriage and its state registration are considered from the position of protection of rights and interests of spouses, some problems of legal regulation are revealed and ways of their solution are offered.

The necessity of the identification and justification of the legal significance of state registration of dissolution of marriage, depending on its termination by the public bodies recording acts of civil status or the court is proved.

Convergence of private and public law the recognition of unworthy heir

Abstract

Subject/theme The article presents the social relations connected with the recognition the heir as unworthy and the manifestation of the process of convergence of private and public law in the area studied.

Goals/objectives The purpose of the study is a comprehensive analysis of certain provisions of Article 1117 of the Civil Code of the Russian Federation as well as the resolution of the Plenum of the Supreme Court of the Russian Federation dated 29.05.2012 № 9 “On judicial practice on inheritance”.

Methodology Universal methods of knowledge; scientific methods, including systematic and logical method and also the analysis, synthesis and analogy; methods such as the method of comparative law and formal legal method have been employed within the study conducted.

ConclusionThe shortcomings of the legal writing for the implementation of the institute of unworthy heirs are the result of the fact that the legal nature of the deprivation of the right of inheritance is not sufficiently studied today and requires close attention and detailed consideration. In turn, the gaps in the system of legal acts accumulate as a chain reaction and can bring the problem of imbalance of legislation against unworthy heirs to a more complex level, transforming the imbalance, for example, from intra-sectoral to inter-sectoral. The application of the convergence process, characterized by convergence, increasing the number of connections and the degree of coherence of the elements in social relations studied can be a solution for overcoming this problem.

To the question of the termination of housing relations in connection with the recognition of a citizen lost the right to use the living room

Abstract

Subject/theme The article presents one of the most common grounds for the termination of housing relations associated with the forfeiture of the right to use a living accomodation in cases where a person loses legal connection with a dwelling and interested persons (proprietors, landlords, employers and other persons) take a legal action.

Goals / objectives. A complex analysis of the features of the recognition of forfeit of the right to use the living quarters not only from the theoretical point of housing law, but also from the law enforcement practice, is conducted.

Methodology The general, general scientific, private-science (formal-legal and comparative-legal) methods of cognition have been employed within the study conducted.

Conclusion The absence of a theoretical consolidation of the features of the recognition of forfeit of the right to use the living quarters creates difficulties in its understanding, and therefore, the present research defines the recognition of a citizen who has lost the right to use a dwelling, and also identifies the characteristic signs of such recognition. In addition, the procedure for proving the absence of a defendant at the place of residence is special and only if there are certain grounds the court can recognize that a citizen has lost the right to use the dwelling whereas there are cases of refusal as well.

The property right in the ussr during the post-war period (1946-1964)

Abstract

Subject / Topic The development of the relations of property and their legal regulation during the specified period and also influence of these factors on social and economic life in RSFSR are analyzed in the light of the recent scientific practices of Russian historians of state and law and the changed estimates of the period of reforms in RSFSR in 1946-1964. The originality of the purposes and tasks which had been moved forward by the Communist Party and public authorities in legal regulation of the public relations is studied and emphasized herewith the attention is focused on prevalence of the public beginnings to the detriment of private-law regulation.

Goals / Objectivess The main goal of the research is to specify some scientific provisions concerning the real situation on legal regulation of the relations of property in RSFSR during the post-war period and in the days of the large-scale administrative, managerial and economic reforms connected with a name of N.S. Khrushchev (the middle of the 1940th – the middle of the 1960th).

Methodology The basic provisions and conclusions of social and deterministic gnoseology of the legal phenomena, dialectic, system and functional approach to their knowledge, embedding in a basis of a research of criteria of objectivity, compliance to the truth, the historical truth, logicality, coherence, unities of logical and historical and also modern general-theoretical ideas of state and law.

Conclusions and Relevance Consideration of contents and specifics of evolution of legal regulation of the relations of property in the mid-forties – the mid-sixties and reflections of these processes in scientific literature allow to conclude that at all shortcomings in general during this period several important changes were made at once: collective farmers received passports; in 1964 pension was established to collective farmers and the salary which became fixed was guaranteed.

Subject/Topic The main ways to ensure the rule of law in the suppression of group disobedience and riots in correctional facilities are considered.

Goals/Objectives The main goal of the present research is to develop proposals on improvement of the effectiveness of measures aimed at suppression of the group disobedience and riots in correctional facilities.

Methodology General scientific and special methods of scientific cognition have been used during the research conducted including analytical, comparative legal, systemic methods etc.

Conclusion and Relevance Based on the practice of emergency response in correctional institutions, it is impossible to agree that the provided by the Correctional Code of the Russian Federation emergency measures are taken only under special conditions. These measures are always implemented in the context of complication of the operational situation, committing crimes, etc., which does not require special permits of higher officials. These measures should be undertaken by the duty officer and other responsible officers in the absence of the chief of the correctional institution.

Normativa de transparencia y protección del consumidor de servicios financieros

Abstract

Modern transformations in a new phase of globalization require a revision of the process of rationalization that corresponds to the development of modern society. Economic breakdowns cause situations and decision-making by agencies to protect the welfare state of the European countries affected. In this context, the protection of consumer rights and interests should be the main goal of all member countries of the European Union in general and the client advocate in particular – financial services (since we will analyze our contribution). The latter will have to ensure that the relationship between the bank and the client is carried out in accordance with the principles of good faith, justice and mutual trust.

However there are certain violations in banking operations that impede the relationship between financial institutions and customers (end-users). In the course of the research we will analyze and clarify the main problems and opportunities that are presented to banks, both in what is said in the current regulations, in the forecasted Law and the Client’s Defender of a financial guarantee to protect the rights of these consumers.

«Transparency» and «Worthiness» in the distribution of insurance products

Abstract

The article presents the concepts of “transparency” and “interests worthy of protection” in the light of the new Italian court ruling on the application of insurance contract law. In the last few years these concepts are increasingly used by the Italian Court of Cassation to determine the validity of contractual regulations which are excessively disproportionate for the benefit of the professional contractual party. The author supports the need to ensure the full protection of the weaker party to the insurance contract not only by the strengthening of formal safeguards which are already long known and used but also through the introduction of new substantial means of legal protection. In point of fact the transparency in its formal sense does not seem to be able to ensure a proper consumer protection in a complex and structured market such as the insurance one anymore.

International legal framework for the establishment and operation of intergovernmental financial organizations in the APR

Abstract

Subject / topic  The subject of the study is the international legal framework for the establishment and activities of the Asian Development Bank, the Asian Bank for Infrastructure Investments (ABIA) and the New BRICS Development Bank.

Goals / objectives The purpose of the research is to analyze the international legal framework for the activities of interregional financial organizations in the Asia-Pacific regiona and to identify the common and distinctive features in their legal position.

Methodology The comparative legal methods, the methods of expert assessments, generalizing indicators, the method of system analysis were applied.

Conclusion The legal nature of the interregional financial development organization is considered. Specific features of the organizational structure of interregional development banks are determined on the basis of the method of comparative legal analysis. A hypothesis was put forward on the possibility of turning ABIA into the most influential international intergovernmental financial organization controlled by countries with emerging financial markets.

On some aspects of information security in the Russian Federation

Abstract

Subject / theme The subject of the study is the social relations developing in the process of ensuring information security of the Russian Federation, in connection with the declared course of building a “knowledge society”, and the simultaneous increase in internal and external threats in the field of information security, in particular, the identification of the essence of understanding the category of “critical information infrastructure”, as well as the systematization of threats to information security of Russia.

Goals / objectives The aim of the study is a comprehensive analysis of the most significant provisions of the Russian legislation in the area of legal regulation and ensuring information security of the state, including several provisions of the Federal law “On information, information technologies and information protection”, Federal law “On the security of critical information infrastructure of the Russian Federation,” the Information Security Doctrine of the Russian Federation and some other regulatory legal acts.

Methodology The methodological basis of the study include general methods of cognition, general scientific methods of research, including the system and logical method, as well as analysis, synthesis and analogy, private scientific methods such as the formal legal method etc.

Conclusion Ensuring information security of the Russian Federation is currently one of the key goals of our state. On the one hand this state of business is due to the increasing role of information technology in public life, and on the other hand, to the increasing number of threats to national information security, both internal and external. In the current situation, it is necessary to note the lack of a comprehensive framework for the implementation of measures to ensure the security of information infrastructure, the insufficient level of development of competitive information technologies, as well as the presence of other negative factors affecting the state and level of security of the information sphere in the Russian Federation.  At the same time, the priority direction of implementation of the state policy in the considered area is to recognize the concentration of state and public efforts to firstly overcome the internal threats to information security such as technological backwardness and high level of crime in the information environment.

Personnel potential in innovative activities

Annotation

Rationale The modern economy is rapidly developing and the introduction of innovations contributes to its intensive growth due to the development of high technology, information production industries, the formation and rapid development of the international and domestic markets of the innovation economy. All these processes contribute to the introduction of relevant knowledge rights, which become the most significant resource.  The knowledge market increasingly serves as the driver of the national economy in most of countries that have the corresponding intellectual potential and therefore the competence and professionality of the staff should become tht main task of social growth in prosperity.

Objective The market of intellectual services in Russia has a very serious potential, but some issues do not have significant elaboration being in the process of formation. In particular, there is almost complete absence of a categorical apparatus (the definition of intellectual services, the place of intellectual services, the structure, functions, content and classification of intellectual services, mechanisms for legal regulation for this type of services etc.). There is no systematic approach to the constant and annual information gathering, although there is a fragmentary collection in certain areas. Thus, the lack of an integrated, systemic approach can lead to uncertainty.

Methods The author of the article analyzes the concept of “innovation” and “innovation activity”, specifies the criteria for assigning an assessment of the employee’s business qualities and proposes to increase the list of criteria for classifying certain qualities as business.

Conclusions and Relevance National innovation system of Russia requires a comprehensive approach to legal regulation and human resources occupy a special role in the innovation process.

Public order in the legislation of the Russian Federation and foreign countries

Abstract

Subject/theme The author of the article analyses a legal institution called public policy in domestic and foreign legislation that allows to filter the application of foreign law to protect the balance of public and private interests. The detailed analysis of the concept of public policy in Russian law is given in this article.

Goals/objectives The purpose of the article is a comprehensive studying of such a legal phenomenon as the public order in domestic and foreign legislation. In order to achieve the above mentioned goal, the author set the following tasks: to study the historical aspects of the public order, to concretize the notion of the public order and to identify its place and role in domestic and foreign law.

Methodology Within the study conducted general scientific methods of system analysis, generalization of legal regulations and practical materials, logical, historical, method and method of comparative law were employed.

Conclusion The author conducted a comprehensive studying of such a complex legal phenomenon as a reservation on a public procedure, which found fixing both in domestic and foreign legislation.

Consideration of the domain disputes in accordance with the UDRP. Prospects of the UDRP implementation in the Russian Federation

Abstract

The paper examines the legal nature of international procedure of UDRP (Uniform Domain Name Dispute Resolution Policy), which was developed in 1999 by ICANN (Internet Corporation for Assigned Names and Numbers) and structure of non-state specialized arbitration centers which deal with a special type of disputes related to domain names. The specialized non-state arbitration centres under the UDPR and commercial arbitration are compared and contrasted in the present article. The author attempts in his study to categorize UDRP procedure in Russian legal system and explores its potential implantation in the area of Russian web. The article presents actual judicial practice and practice of arbitration centers.

The application of modern technologies in intellectual law

Abstract

In this paper the application of modern technologies, in particular, “blockchain” technology in intellectual law, is considered. It explains the advantages of this technology, the technologies of the past generations – such as server storage, and “cloud” storage. The principle of the blockchain network and its immediate advantage are explained. A number of examples are given, when the technology of the last generation has been already applied in various registers of different levels. This is a variety of international and domestic registries. The concept of the so-called “orphan work” is given. In this work examples of objects of intellectual rights and the moment of their creation are considered. The organizations which maintain registers of various intellectual property objects and approximately all of their variety and diversity are revealed. The examples of commercial, non-commercial, state, and even inter-state organizations, which are maintained by those registers referred to above are given. International legal acts and codified laws of the Russian Federation are considered. The example of some of the problems that can be resolved more quickly and efficiently using modern technologies in intellectual law is given. The author also presents the factors necessary for the development of high-tech business and the free exchange of scientific information.

The signs of unfair competition related to the creation of confusion

Abstract

At the present stage of the development of the Russian Federation the protection of economic entities is the most important factor in the mobility of the economy in a competitive environment. In this regard the author draws attention to one of the necessary elements of protection in economic circulation dictated by unfair competition, based on a mixture of goods creation. The aim of the work is to analyze the current rules of law in unfair competition associated with the creation of confusion, as well as the practical solution of these issues in courts that identify the specific features of the relevant judicial practice. The relevance of the research topic is based on the provisions of the Civil Code of the Russian Federation and the Federal Law “On Protection of Competition” which are correlated with the specifics of law enforcement and judicial practice on the issues of creating a mixture of goods in a market economy. The author examines the judicial practice and analyzes the features of dispute settlement and ways to protect the rightholders of trademarks, goods and services and offers possible solutions for improving judicial practice when considering issues related to the mixing of goods and services in courts.
