About constitutionality of part of the second article 377 CPC of the Russian Federation

Abstract.

In article the conclusion that the persons allocated earlier (till January 1, 2012) the right for consideration of the appeal complaint for resolutions of the world judge by rules of the full appeal, in the conditions of new legal regulation in connection with unification of appeal production, lost such right is drawn. It is possible to speak with big degree of confidence about violation of the principle of equal access of participants of the civil procedural relations to justice regarding the appeal, the judicial resolutions which have entered validity adopted on civil cases, relating to one category. The part 2 of article 377 of the Code of civil procedure of the Russian Federation and the resolution of the Constitutional Court of the Russian Federation of February 5, 2007 No. 2-P are analysed from constitutionality positions. Introduction of new legal regulation established a new order of hearing of cases by vessels of appeal instance which is uniform for consideration of appeal complaints and representations on decisions of the courts of the general jurisdiction of all levels. The only difference in relation to revision of decisions of world judges – in comparison with the order established for revision of solutions of all other vessels, – is the structure of court of appeal instance: for verification of solutions of all vessels, except world judges, joint consideration (as a part of the judge – the chairman and two professional judges), and for decisions of world judges – individual consideration of the case by the judge of the relevant district court is provided.

Extrajudicial protection of the rights and legitimate interests of physical and legal persons

Abstract.

The article considers extrajudicial protection of the rights and legitimate interests of physical and legal persons, specify which bodies are entitled to consider and resolve disputes arising from civil, labor relations. You also specify the notarial form of protection of rights and legitimate interests of physical and legal persons. Shows which actions may be taken by public notaries notaries engaged in private practice. Analyse the types of questions may consider mediators (intermediaries) in accordance with the Federal law «On alternative dispute resolution with the participation of the mediator (mediation procedure). To specify which categories of cases may consider arbitration courts.

Problematic aspects of oversight activities regulation for the observance of the housing legislation: theoretical and legal approaches in the legal literature

Abstract.

The article describes the main theoretical approaches to the legal nature of regulatory oversight in the housing sector at the present stage. The characteristics of the problems in the law and practice, are made, as well as the statistics of offenses, sociological data illustrated the attitude of the Russian population in the implementation of housing supervision. Particular attention is paid to the role of the Prosecution Service, the Federal Service for Supervision of Consumer Rights Protection and Human Welfare, the Federal Registration Service and housing inspection in monitoring activities carried out.

The power of corruption

Abstract.

This paper provides the first analysis of the notion of corruption according to the most relevant sociological theories and a definition of corruption in the Italian State according to the Italian legal system. It also develops a conceptual framework of the power of corruption as a worldwide social pathology representing a grave risk for all Democratic countries. The author presents two guidelines to approach the notion of corruption. First, a definition and a diachronic analysis from Greek legislation to modern legislation (corruption today) and then a synchronic overview on the most important NGO dealing with the main anti-corruption organizations and instruments and the role of Italy as a member State: GRECO (Council of Europe anti-corruption Group) and Transparency International. This article shows how a fragmentary social structure and a semi permanent political crisis gives way to both a new bottom – up type of growth and on the other hand to deviant behaviours. To the author’s knowledge, corruption is a consequence of social tensions as well as a determining factor of stability of a given structure of power and the outcome of the article is a perfect and synthetic overview on the measuring instruments for the perception of corruption especially in Italy.

Features of the methodology of the study of war

Abstract.

The article analyses certain historical aspects of the methodology of scientific research of military provisions is based on the original methodology of scientific cognition of this multi-faceted, complex object. At the same time, the author brings arguments regarding the need to use proven methodological techniques, including the administrative-legal institution in the system strictly tuned and tested principles, methods, rules and regulations. Substantiates the claim that the methodological analysis of the military situation must be carried out at both the empirical and theoretical level.

CAO RF accumulates negative potential

Annotation.

The rapid development of public relations in the sphere of public administration encourages the Federal legislator and executive power to the same active legal regulation in this area. Often the norm-setting activity of the public authorities has, on its own initiative. In any case, many of the new regulations require legal protection against violations, resulting in an avalanche-like making changes and additions to the code of administrative offences. In this regard, the code increases in volume, takes the form of distorted, creating problems in enforcement. As a result there was an urgent need for revising either of the code of administrative offences, either in the preparation of the draft of the new code.

Defense of rights of participants of public procurement during integration of Russia in global economic area

Abstract:

The article is devoted to issues of defense of rights of participants of public procurement during integration of Russia in global economic area. This involves rights of both foreign participants and domestic manufacturers. Author notes that now national regime is allowed to foreign participants as a general rule. He says about protection of domestic manufacturers by granting of preferences. Author emphasizes pre-court (administrative) and judicial ways of dispute resolution. International and foreign experience of legal regulation of these relations is considered.

Problems of protection of rights of economic entities in the period of martial law

Abstract.

The article considers some issues of state regulation of national economy in the period of the special legal regimes (in particular, the regime of martial law). The main attention is paid to the problems of legal regulation of activities of economic entities, as well as protection of rights of economic entities in the period of martial law. The basic drawbacks of the current legislation, which do not allow to ensure the protection of rights of businesses during the period of martial law.

Problems of protection of rights of economic entities in the return of overpaid customs payments

Abstract.

The authors consider the problem of determining the customs value of goods. Describes the disputable situation which has arisen as a result of adoption by the customs body of the Decision on the adjustment of the customs value of the goods. Discusses the arguments of the customs authority and the declarant. The question is considered from two sides by theory and by law enforcement practice.

Abstract:

Testament as a means of realizing the right of inheritance (questions of interpretation enforcement)

Abstract.

Guaranteed by the Constitution of the Russian Federation the property right and the right of inheritance find their continuation in the right of the citizen to bequeath its property and property rights. The demand of wills as a way of disposal in case of death increases in connection with the removal of restrictions on the types of property owned by citizens, the expansion of freedom of the will. An important component of inheritance by will is its interpretation and execution, otherwise lose the sense of order in case of death. The interpretation and execution of a will provide the legal result, which were chosen by the testator, doing the will.

Abstract.

The question of lack of workplaces has become particularly acute in the European Union. Stunning data on the number of unemployed is given by statistical agencies, mass media and other public organizations confirm existence of the serious problem concerning number not only developing states, but also the states developed in the economic plan.
