Professional religious training in the USSR: a historical and legal perspective

Annotation

Subjest/topic This article gives the historical and legal analysis of the professional religious education development in the Soviet Union in the context of state – religious relations during the Soviet period.

Goals/objectives The article is aimed at pointing out to the characteristics of legal regulation of the religious education in the USSR, and also at showing how the Soviet regulation in that field had been implemented in practice.

Methodology General scientific methods have been used in the analysis. The systematic approach to studying the history of legal regulation means that the legislation and its implementation practice during the Soviet period of Russian history are studied along with the inner church regulations and practice.

Conclusions The status of religious education certificates issued by religious associations during the Soviet period needs further consideration. It might be important to set up a special procedure of state recognition of the religious diplomas and degrees in theology.

Principles of law and a promising model of compulsory licensing in the context of intellectual property management in the russian federation

Annotation

Topic The article explores the relationship between the principles of law and a promising model of compulsory licensing in the field of intellectual property in the Russian Federation.

Research goals/objectives analysis of compulsory licensing as an intellectual property management tool in the Russian Federation through the prism of legal principles such as fairness, proportionality and legal certainty. The aim of the work is to develop a promising model that balances the interests of copyright holders and society in accordance with these principles.

Methodology Analysis of Russian legislation, international norms, foreign experience and general scientific methods, the method of comparative legal analysis was used.

Study results a promising model based on the principles of transparency and fairness of the licensing procedure, guaranteed and adequate compensation to the copyright holder, a limited license period and control over the use of intellectual property is presented. The model takes into account the balance of public and private interests. When deciding on compulsory licensing, it is proposed to take into account criteria such as access to life-saving medicines or technologies in times of crisis.

Conclusion As a result of the study, it was found that the current system of compulsory licensing in the Russian Federation needs to be improved to ensure compliance with the principles of law and increase efficiency. The developed perspective model, based on the analysis of international experience and the principles of justice, proportionality and legal certainty, offers mechanisms for balancing the interests of copyright holders and society. The implementation of the proposed recommendations will optimize the management of intellectual property and stimulate innovative development.

Artificial intelligence and civil liability

Annotation

Subject/topic The exponential development of technologies equipped with artificial intelligence gives rise to disputes not only about their potential legal capacity, but also about what the liability will be in the event of harm caused by these technologies, and who will be the subject of this liability. In this article, the author will try to reveal some of the approaches to the models of liability for harm caused by artificial intelligence technologies.

Goals/objectives The purpose of the study is to analyze some approaches to liability for harm caused by artificial intelligence technologies that exist in the scientific world. The objective of the study is an attempt to draw a conclusion about the most optimal algorithm of actions when deciding on establishing the subject responsible for the harm caused by the technologies in question.

Methodology The methodological basis of the study was made up of both general scientific and specific scientific methods: formal-legal, comparative-legal.

Results/conclusions In the course of the analysis, the author comes to the conclusion that the most optimal option when considering the issue of choosing a liability model for harm caused by artificial intelligence technologies is the institution of a source of increased danger. It seems that this model is aimed at ensuring the protection of citizens’ rights, since it allows us to clearly determine who is the responsible subject, namely the owner of such a source. In order to eliminate legal uncertainty when extending the provisions of Article 1079 of the Civil Code of the Russian Federation, the author believes it is appropriate to make appropriate changes to this article.

The influence of doctrinal approaches on the development of legislation on the use of artificial intelligence for business purposes

Annotation

Subject / topic. The scientific article describes various doctrinal approaches in the legal literature and shows their impact on the development of Russian legislation on the use of artificial intelligence for business purposes in the context of technological transformations at the present stage.

Goals / objectives. The purpose of the article is to establish promising directions for the development of legislation on the use of artificial intelligence in business and other activities, taking into account the formation of consensus in understanding the legal content of the concept of artificial intelligence and its legal nature among legislators and law enforcement officials.

Methodology. Being end-to-end, artificial intelligence technologies have an interdisciplinary and intersectoral character, and the definitions formulated in legislative acts should reflect their legal content and correspond to the signs of legal certainty, so that there are no discrepancies and ambiguity of their understanding in the law enforcement process, including in business activities.

It is important to take into account the breadth of industry-specific applications of artificial intelligence and the multilevel nature of legal regulation, which will make it possible to develop an optimal model of legal support for the introduction of future technologies, in general, and taking into account industry specifics, in particular.

The brand of the state: repositioning through the legacy of Ancient Rome

Annotation

The subject/topic The article is devoted to the study of the experience of the Roman Empire as a basis for the development of modern sustainable models of public administration and national branding.

Goals/objectives. The aim is to study the patterns that ensured the success and sustainability of the Roman Empire, and to adapt them to enhance the competitiveness of modern states. Special attention is paid to building economic and social models focused on the development of human capital, legal protection and the creation of an attractive image of the state.

Methodology The work uses an interdisciplinary approach combining historical analysis, marketing research and modern technologies, including blockchain, artificial intelligence and smart contracts. The article examines the practices of adapting Rome’s experience through the prism of modern theories of country marketing, investment, and citizen happiness.

Conclusions An analysis of the experience of the Roman Empire shows that the sustainability of the state system is achieved by meeting the needs of citizens, increasing their level of happiness and creating a strong national brand. Modern technologies and marketing approaches make it possible to turn historical lessons into tools for strengthening international competitiveness and attracting investments. The main factor in the success of the state remains the focus on the well-being of the population, which lays the foundation for long-term growth and stability.

Review of the monograph M.V. Anisiforova Administrative and legal regulation of drug circulation

Abstract

The article provides a scientific analysis of the content of the monograph by Doctor of Law Maryam Vladimirovna Anisiforova, dedicated to the insufficiently studied problem of administrative and legal regulation of the circulation of narcotic drugs and psychotropic substances, their analogues, new potentially dangerous psychoactive substances, as well as drug-containing plants and parts of such plants (hereinafter collectively referred to as drugs, unless otherwise specified). The relevance of the research topic is confirmed, the positive and most controversial aspects and moments of the research are noted: original author’s conclusions, judgments, inferences, statements, arguments, proposals and recommendations that are important both for public law doctrine and for the practice of state and municipal administration in terms of control (supervision) over the legal circulation and consumption of drugs. The merit of the research is its interdisciplinary nature, it is based on the provisions of jurisprudence, management theory, philosophy, psychology, medicine, including psychiatry, sociology, morality, ethics, morality and other areas of scientific knowledge. Attention is drawn to individual aspects and fragments of the monographic research, leaving room for scientific controversy. A final assessment of the monograph is given, recommendations are made regarding the continuation of research in this direction.
