Priorities of national security of the state as a scientific category

Abstract

Subject/topic. National security priorities of the state as a scientific category.

Goals/tasks. In the article, the author analyzes modern doctrinal approaches to national priorities identified by scientists as such, based on the analysis of approaches that have developed regarding the interpretation of the term “strategic priorities of the state”, as well as the main provisions of the basic documents of national, state and public security of the Russian Federation. The author’s attention is focused on problems related to state and public safety, as well as the safety of the educational environment, as complex strategic priorities that have a direct projection on the current state of protection of the state, society, and man from criminal manifestations and the unresolved significant number of problems of legal regulation of this area. Equally, the problems of ensuring the safety of the educational space and unresolved problems in this area are directly related to the formation and upbringing of a modern citizen of Russia, as a harmoniously developed and socially.

Methodology. Analysis, synthesis, problem statement, hypothesis building.

Conclusion: Based on the results of the analysis, the author comes to the conclusion that state and public security, which are strategic national priorities for ensuring the national security of the Russian Federation, need substantive legal regulation and preparation by the scientific community of theoretical models in this area. As well as ensuring the safety of the educational environment of universities, the formation of an educational space adequate to the needs of society and the state will make it possible to achieve the formation of a citizen of Russia.

The genesis of the development of russian legislation on the provision of services using digital technologies

Abstract

Subject/topic It is difficult to over estimate the importance of the development of digital technologies in the modern economy and especially in the field of service provision, since services are such objects of civil rights that do not have a property embodiment and consistinactions that do not entail material results for the service recipient, and the digital for mispossible both as one of the elements of their provision and as the essence of a separate and independent service. The subject of the study is the relations related to the conclusion and execution of contracts for the provision of services using digital technologies, i.e. services, the subject of which is activity in the digital environment, and activities for the application of the results of the use of digital technologies.

Goals/task The purpose of the studyis to analyze the development and problems of the implementation of the provision of services using digital technologies. The object of the workwas the norms of Russian legislation regulating relations in the field of providing services using digital technologies, judicial practice of their application and scientific (civil) literature devoted to them, as well as statistical data. Methodology. The methodological basis of scientific research has become universal(analysis, generalization) and private law, formal legal techniques.

Conclusion The result of the research is the author’s conclusions regarding the establishment of legalfeatures and trends in the regulation of legal relationsin the field of digital services, a range of legal problems is formulated, and the author’s definition of the contract that forms the material basis of legal relationsin the field of digital services.

Foreign persons in civil proceedings: comparative characteristics

Abstract

Subject/topic The subject of the study is social relations arising in the process of legal regulation of the procedural status of foreign persons in civil proceedings.

Goals/objectives The purpose of the study is to identify the specifics of proceedings involving foreign persons in the Russian Federation by studying regulatory legal acts and considering them in practice by courts of East Asian and Middle Eastern countries. The purpose of the study is to compare the legislative consolidation of the participation of foreign persons in the civil process of the countries of East Asia and the Middle East with the Russian Federation, to determine the specifics of the participation of a foreign person in civil proceedings, to identify problems that arise when considering and resolving civil cases involving foreign persons by the courts of the countries under study.

Methodology The methodology of the study was composed of both general scientific methods and a private scientific method, which implies a comparative legal, historical-legal and method of legal statistics.

Conclusion The study of the legal status of a foreign person in civil proceedings in the Russian Federation is sufficiently regulated by the current legislation, but nevertheless, during the study and analysis of the peculiarities of foreign persons’ participation in civil proceedings, it was concluded that it would be advisable to make some additions, which will only contribute to the development of the institution of participation of a foreign person in civil proceedings of the Russian Federation.

Amendments to administrative-tort prohibitions and restrictions in migration legislation

Annotation

Subject/topic The article is devoted to the analysis of modern changes made to the migration legislation of the Russian Federation, an assessment of their legal, political and social significance, as well as the protective potential contained in them regarding the rights and freedoms of citizens of the Russian Federation, foreign citizens and stateless persons.

Goals/objectives The purpose of the article is to determine, in the first approximation, using scientific means, the expected effectiveness of legislatively enshrined administrative-tort prohibitions and restrictions from the standpoint of law enforcement practice.

Methodology In preparing the article, general scientific (observation, comparison, description, analysis, synthesis, etc.) and specific scientific (formal-legal, comparative-legal, statistical, etc.) methods were used. The dialectical method allowed us to study the prerequisites of legislative innovations, to form a scientific argumentation regarding the need to establish stricter requirements and rules in the field of migration relations. The comparative legal method made it possible to identify and substantiate the similarities and differences between them by comparing various legal sources. The formal legal method was used in the analysis of legislative norms. The statistical method was used to form a clearer theoretical understanding of the situation that has developed in the country in the area of migration relations.

Results/conclusions The prohibitions and restrictions introduced into the administrative legislation of the Russian Federation, which are a consequence of the violation by foreign citizens and stateless persons of the legal norms and rules established in our country, will largely contribute to the maintenance of law and order, the achievement of the interests of the individual, society and the state in the area of migration relations.

On the issue of expanding the penalization and criminalization of child abuse

Abstract

Subject/topic The subject of the study is social relations related to the manifestations of cruelty against children and responsibility for them.

Goals/task The purpose of the study is to identify and analyze public relations containing manifestations of cruelty against children, their classification, identify gaps in Russian legislation regarding responsibility for child abuse and formulate proposals to expand their penalization and criminalization.

Methodology The methodological basis is both sociological, normative–ethical, and formal-dogmatic methods of cognition of objective legal reality, as well as philosophical (epistemological) methods of systematization and legal modeling.

Conclusion The cruelty of adults towards children who are not capable of independently defending their rights, either physically or legally, is receiving an increasingly negative reaction in Russian society. The idea of increased protection of children’s rights unites all social strata, all nationalities and religious denominations. However, the legal forms of this protection, its state organization and legal procedures are still the subject of both public and scientific discussion. The work identifies existing types and forms of child abuse, proposes a system of new compounds covering all forms of abuse and substantiates the social need for their establishment.

Institutional support for the interaction of the state and civil society: administrative and legal aspect

Abstract

Subject / Topic. The subject of the study is the legal relations that arise in the process of interaction between public authorities and civil society institutions with appropriate institutional support.

Goals / Objectives. The purpose of the study is to analyze the administrative and legal regulation of the system of institutions that ensure the interaction of the state and civil society. The author examines the problems of the activity of individual elements of the system under consideration and identifies the features of some public-state institutions, makes proposals for the development of legal organization of interaction between public authorities and civil society, and notes the prospects for the development of these issues. An assessment of the effectiveness of public control mechanisms and citizen participation in public administration has been carried out. The article aims to provide a comprehensive analysis and practical recommendations that can be useful for scientists, jurists, civil servants and representatives of civil society seeking to strengthen democratic principles and improve the effectiveness of public administration.

Methodology. Methods of description, comparison, and analysis were used.

Conclusion and Relevance. The study revealed gaps in the administrative and legal regulation of the activities of institutions that promote interaction between the state and civil society. The elements of the system of institutions that promote the interaction of the state and civil society together and separately are considered. The author offers recommendations for improving institutional support for the interaction of the state and civil society, which contributes to strengthening democratic principles and increasing confidence in state institutions.

The institute of reputation in Ancient Rome

Annotation

Subject/topic This study analyzes the social and legal structures of Ancient Rome through the prism of litigation and reputational capital. The article highlights numerous cases demonstrating the impact of reputation on the outcome of trials and the lives of participants in the judicial system. In general, the article explores the importance of reputation capital in a historical context and its evolution in the modern world. There is also an abstract to the text on the literary analysis of the reflections of Marcus Aurelius, which became the basis for research in the field of neurophysiology, the colleges of Ancient Rome and the relevance of deregulation in the modern business environment within the framework of Russian legislation.

Goals/objectives The text examines in detail the author’s key thoughts, such as the definition of aggression, the crafts used in Ancient Rome, the influence of colleges on society and the importance of deregulation of entrepreneurial activity for economic growth. The importance of creating a positive environment for the development of the business community and the need for the approval of state institutions that contribute to the creation of a productive environment for entrepreneurs is emphasized. One of the main goals is the need to approve state institutions to create a productive environment for entrepreneurs, as well as to identify the importance of creating a positive environment for the development of the business community.

Methodology The methodological basis of the research of the article is based on the analysis. In particular, the author gives examples where reputational capital was more expensive than even rights and money, and how letters of recommendation and connections of influential people played a decisive role. The influence of reputation on political ambitions and meritocracy is also considered.

Conclusions The author concludes that humanistic capital based on humanity and personal values is a key factor in the development of society and the state. The text reasonably connects the ideas of ancient philosophers with modern trends and offers practical recommendations for the development of entrepreneurship in Russia. The study of the text allows us to see the depth and versatility of Marcus Aurelius’ thoughts and apply them in the context of modern society to achieve productive interaction and economic development.

International legal ensuring of radiation safety in the light of new threats

Annotation

Subject\topic The subject of the article is the analysis of international legal provision of radiation safety in the context of modern threats. The research focuses on the study of existing international and national regulatory legal acts regulating radiation safety issues in the current geopolitical situation and modern challenges.

Goals\task The purpose of this study is a comprehensive analysis of the international legal regulation of radiation safety at various levels. The author analyzes potential changes in the military-political situation that may affect aspects of radiation safety and possible consequences.

Methodology The research uses methods of analysis, synthesis, dialectical, system-structural, historical, logical-legal, comparative-legal, and other methods of scientific cognition.

Conclusion As a result of the conducted research, new threats to radiation safety at nuclear power plants were noted, among which: possible terrorist attacks on nuclear power plant facilities, increased possibility of manufacturing a “dirty bomb” and the danger of increasing escalation of conflicts near nuclear power plants. It is recommended to develop and implement additional norms and standards that take into account the latest technological and geopolitical changes, as well as strengthen international cooperation in the field of information and resource exchange for effective protection against radiation threats.

Issues of understanding the counteraction to offenses

Annotation

Subject/topic The article examines scientists’ understanding of the term “counteraction” to offenses, examines the national legislative consolidation of the term in question. The analysis of similar concepts such as “prevention”, “prevention”, “prevention”, “fight against crime”, “suppression” is given.

Goals/objectives The purpose of the study is to study the positions of understanding the term “counteraction” to offenses in the scientific literature and Russian legislation. To achieve this goal, the following tasks were set: to identify common features and differences between the term “countering” offenses and “prevention”, “prophylaxis”, “averting”, “combating crime”, “suppression” of offenses.

Methodology General scientific methods such as the logical method, the comparative method, the method of generalization, deduction and induction were used.

Conclusion The article concludes that there is no consensus in science on the understanding of the term “counteraction”. It is similar in terms of the content of activities with “prevention”, “fight against crime”, but these concepts are different in their purpose. It is also noted that the fight against crime and counteraction do not correlate as a whole and its part due to the fact that these measures overlap only in the “suppression” of crime, when the criminal plan begins to be realized. It is concluded that the legislator attempted to consolidate the definition of countering offenses in federal laws concerning certain groups of crimes. This indicates a terminological confusion, which has been repeatedly pointed out by scientists.

General theoretical problems of legal conflictology

Abstract

Subject/topic An overview of the speeches of the participants of the All-Russian scientific and practical round table “Legal conflictology: problems and prospects”, held on January 18, 2024 at the All-Russian State University of Justice (RLA of the Ministry of Justice of Russia), devoted to general theoretical problems of legal conflictology, is presented.

Goals/objectives Identifying the most pressing problems of modern Russian legal conflictology as a scientific direction of legal research and a field of practical professional activity of lawyers, determining further paths of scientific knowledge of the patterns of legal conflicts and using the achievements of legal conflictology to improve modern domestic political and legal practice.

Methodology The methodological basis of the study was formed by the general philosophical method of dialectics, the method of formal logic, abstraction, systemic-structural, ascent from the abstract to the concrete and a number of others.

Results/Conclusions It is substantiated about the conflict as a permanent social phenomenon and the productivity of such an understanding of legal conflict; about legal conflict as a factor in identifying contradictions, collisions in law, and the development of legal practice; about the need to use factual data on the forms and sequence of conflict resolution in primitive society and their doctrinal assessment for the purpose of improving the use of legal means in modern times; about the need to take into account the patterns of dialectical interaction of the general, the particular and the individual when using methods, technology and other means of legal conflictology; about the legal nature of mediation; about the shortcomings of government systems and the conflicts arising from them; On the nature of civil war as a special type of armed conflict, in which the former state and its inherent legal system disintegrate into several internally ordered structures fighting each other, each of which contains the basic elements of the state and has its own legal system; On the need to consider the effectiveness of forms of legal interaction: cooperation and conflict; On the choice of a method for resolving information conflicts; On the concept of “ethnity” as a special state and legal construct determined by interethnic contradictions; On the practical application of the fundamentals of legal conflictology in judicial proceedings, in particular, in the confrontation between a prosecutor and a lawyer; On the importance of publicity of state activities to ensure the communicative component of a conflict as a conflict-generating factor and as a preventive factor; On the connection between law and conflictology through the philosophical categories of essence and existence.
